City Reaches Settlement in Splash Pad Sewage Case

A dispute over a 2013 splash pad renovation could be drawing to an end as Traverse City, Mich., commissioners accepted a settlement for $300,000. The city blamed the firm Hamilton Anderson Associates for design flaws that led to water contaminated with sewage to rain down on children.

A direct connection between the city’s sewer system and the splash pad caused the problem. Mayor Jim Carruthers had said previously that he wanted the city to be reimbursed for the costs to fix the park.

According to the Traverse City Record-Eagle, city commissioners unanimously approved the settlement, which will cover some of the costs and bring the years-long dispute to a close. 

“It’s completed, done and over,” city manager Marty Colburn said. “We move forward.”

The city offered no public comment, but city attorney Lauren Trible-Laucht said that a copy of the settlement would not be released until after it had been executed. 

“We’ve accepted the offer of settlement that was made as the motion indicated,” Trible-Laucht said. “We’ll be working to finalize that settlement agreement.”
