Planet Fitness Wins Suit Over Transgender Locker Policy

On Thursday, the Michigan Appeals Court issued a three-naught decision in favor of a Midland Planet Fitness that terminated a member’s contract after she complained about the facility’s transgender-friendly locker room policy.

In 2015, Yvette Cormier encountered a transgender woman in the Planet Fitness locker room and broadcast the incident to other gym members, complaining about the policy. A week later, Planet Fitness terminated Cormier’s membership.

Cormier filed a lawsuit claiming violation of the Elliot-Larsen Civil Rights Act for breach of contract. Midland County Circuit judge Michael Beale wrote an opinion January fourth dismissing the suit and rejecting Cormier’s claim of “quid pro quo” sexual harassment.

At the time, a legal representative for Cormier told mLIVE that Beale’s ruling “ignores the fact that Planet Fitness' policy allowing the presence of a man in the women's locker room when women are in various stages of undress is offensive behavior in and of itself." 

According to ClickonDetroit, Cormier appealed the ruling in January, and the case was heard again on June first by the Michigan Appeals Court, which ruled in favor of Planet Fitness, finding no evidence to support Cormier’s claim of sexual harassment.
