Aubrea Danks of Farmington, N.M., is suing the city of Bloomfield alleging that her six-year-old son lost a toe in July 2017 at the municipality’s Family Aquatic Center.
In her complaint, filed last week in the district court, Danks says the boy’s toe was severed as he went down the water slide. Danks is claiming failure on the city’s part to property construct and maintain the facility.
Danks’ attorney, Shawn Cummings of the Bloomfield-based firm Keller & Keller, said while he handles a lot of personal-injury claims, this case caught his special attention. “This one definitely stood out to me as something that should not have happened,” he said.
As of Wednesday afternoon, city attorney Ryan Lane told the Farmington Daily Times that the city had not yet received any complaints connected to the incident, and denied any negligence on the part of the city.
“We keep everything safe and well maintained, especially where children are involved,” he said.
The amount in damages sought by Danks is yet to be made public.
