Missouri School District Settles Lawsuit with Gym Floor Installer

A Missouri school district settled a lawsuit with a gym flooring installer after it was determined issues with the district’s gym floor were caused by the improper use of de-humidification systems by the school district, the Cassville-Democrat reported.

The Wheaton school district filed a $90,000 lawsuit against 4 State Maintenance Supply in 2021, alleging “insufficient workmanship” that caused separation of boards; peeling paint; unfinished, exposed boards; and “dead spots” in the flooring. The Coffeyville, Kan.-based flooring installer denied the allegation and argued the school district had failed to maintain proper humidity levels in the facility, which caused the damage and was not covered by its warranty. The floor was installed from March toJuly 2020, for a total cost of $106,773.

An inspection concluded the damage was not related to defective construction and that the separation of the flooring surface and dead spots were the result of improper environmental controls after the floor’s installation.

The settlement releases 4 State Maintenance Supply from any and all liability relating to the gym floor. The company’s insurer settled with the school district out of court.
