Alabama Mother Sues Catholic School Alleging Son Was Urinated On, Injured by Football Teammate

A mother has alleged in a lawsuit that her son was bullied , urinated on and injured with an aerosol spray can by another student while attending a school controlled by the Catholic Archdiocese of Mobile, Ala., earlier this year.

As reported by Patrick Darrington of al.com, Nichole Hollins filed the lawsuit in the Circuit Court of Mobile County. She names as defendants the Archdiocese of Mobile and several employees of McGill-Toolen Catholic School — including a former principal, a former athletic director and head football coach David Griffin — due to their supervisory roles at the time of the alleged bullying Hollins’ son endured.

Per Darrington's reporting, the complaint alleges that on March 18 Hollins’ son, referred to as M.W., was a freshman football player and participated in workouts that morning before class.

While M.W. was showering, another student-athlete referred to as D.A.F. came up and “inexplicably and without reason” urinated on M.W.

The complaint states that D.A.F. was an upperclassman and member of the football team. The lawsuit alleges that the next day D.A.F. again urinated on M.W. while showering before class.

The suit claims that on March 20, M.W. urinated in a bottle and poured it on D.A.F. to prevent the bullying but this only angered the upperclassman, who said, “I’m going to f*** you up!”

Shortly thereafter, as M.W. was getting dressed for class, D.A.F. threw an aerosol can of deodorant at M.W.

“D.A.F. threw the can directly at M.W.’s head and face," the lawsuit alleges. "D.A.F. threw the can with such force that M.W. lost vision in his left eye, underwent surgery, sustained a brain injury and suffers from debilitating headaches to this day.” 

The suit seeks compensatory damages for negligence and harm that the defendants allegedly failed to prevent happening to M.W. in violation of their duties. The plaintiffs seek a trial by jury, alleging that the defendants violated the Alabama Student Harassment Prevention Act by allowing M.W. to be bullied on multiple occasions, Darrington reported.
