Blackfoot School District 55 and its employees were dismissed from a lawsuit Monday filed in connection with a 2010 hazing case that involved members of the Blackfoot boys basketball team.
The request to dismiss Blackfoot School District 55, former District 55 Superintendent Scott Crane and former Blackfoot High School Principal Blaine McInelly was filed Jan. 23.
In the hazing case, a number of basketball players were charged with felonies that later were dismissed. Dismissal of the charges led to lawsuits against multiple public agencies and officials.
The players were charged after reports of hazing emerged during the 2009-10 basketball season. Eventually, Logan Chidester, Nathan Walker and Tyson Katseanes were convicted of misdemeanors.
Chidester, Walker and Katseanes filed a complaint Nov. 30, 2012, against former Bingham County Chief Deputy Prosecutor Randy Smith, former Bingham County Prosecutor J. Scott Andrew, former Blackfoot Police Chief David Moore and former Blackfoot Police Capt. Kurt Asmus.
Additionally, the complaint contained allegations against Justin Dance, a detective with the Blackfoot Police Department, as well as other Blackfoot city and Bingham County employees.
Crane and McInelly were also named in the complaint but were dismissed with prejudice. The term ""with prejudice"" means allegations against the district, Crane and McInelly cannot be brought before the court again.
The document filed at the Bingham County Courthouse did not specify why the former basketball players agreed to have the school district and its former employees dismissed from the case.
The lawsuit against the other defendants is pending. The next court date is set for 11 a.m. Feb. 21.
