West Virginia Lawmakers Vote to End Immediate Eligibility for Transferring Student-Athletes

The West Virginia House of Delegates passed HB4425 with an overwhelming majority, 78 to 19, ending immediate eligibility for high school student-athlete transfers. The bill will now advance to the Senate. 

According to WCHSTV, lawmakers debated fairness, student protections and power balance in high school athletics. The bill overturns a 2023 rule that allowed student-athletes to compete immediately after transferring schools.  

“The unbalance of competition that we have created, the exchange out of a community circumstance to people moving from one school to another for whatever their reasons may be — it’s not healthy. It’s not good," said HB4425 sponsor Marty Gearheart.

Now, the state will return to the 2023 rules that required student-athletes to sit out a year before regaining their high school eligibility.

“Some student athletes and their parents who have put in everything — time, sweat, the concession stand, the car wash, practice, everything — to earn that spot on the team. Then a transfer comes in and boom, they’re out,” Representative Dana Ferrell said. “There’s collateral damage. There aren’t any real winners.”

In voting on this issue, the House of Delegates also brought into question whether the West Virginia Secondary Schools Activities Commission should have control over student-athlete transfer and eligibility rules. 

The WVSSAC released a statement saying, “The West Virginia Secondary School Activities Commission appreciates the actions taken by the House of Delegates to repeal the current transfer statute. This represents an important step toward restoring a consistent and structured transfer policy for high school athletics in West Virginia. If passed by the Senate, the repeal would allow the WVSSAC to use input from its member schools and promulgate the transfer rule. These guidelines would support both school choice and competitive balance while providing clear expectations for students and member schools. The WVSSAC encourages the Senate to continue consideration of this legislation to ensure a fair and orderly framework for education-based athletics across the state.”
