Ticket Reseller Sues University of Michigan Over Policy That Allegedly Cost Him $2.5M in Revenue

A North Carolina-based ticket holder and reseller Maxim Tickets is suing the University of Michigan over the school's new season ticket policy, alleging the changes will cost Maxim Tickets $2.5 million in lost revenue. 

Kevin Brick and his ticket resale company Maxim Tickets, Inc. has sued the university for “unfair, unconscionable, and deceptive business practices” in violation of the Michigan Consumer Protection Act.

As reported by MLive.com, Brick's lawsuit alleges that without warning the UM athletic department prohibited people from buying tickets solely to resell them and blocked him from tickets he had already purchased. Brick had bought hundreds of tickets for 21 years, alleging that the policy change misled him into spending millions of dollars without the possibility of making the money back. 

Brick estimates his company will lose $2.5 million to $3.5 million in revenue per year due to this change, the lawsuit alleges.

“Despite UM’s longstanding policy of allowing resale and transfer of football season’s tickets, it unilaterally changed its terms and conditions without (our) consent or knowledge in (and) around 2023,” the lawsuit alleges.

The lawsuit alleges the university is also guilty of fraud, negligent misrepresentation, intentional interference of business practices and breach of contract. 

Brick and Maxim Tickets are also accusing the university of violating the state’s Freedom of Information Act by withholding internal documents on the ticket policy and communications to current or prospective ticket holders.

Brick and Maxim Tickets seek $2 million in damages, the lawsuit states.
