A former youth football coach in Dubuque, Iowa, who was sentenced to 10 years in prison for stealing from a youth football league will be resentenced by a new judge.
According to KCRG, Darrell Moore, 40, previously served as president of the Dubuque Independent Football League. He pleaded guilty in January to first degree theft. His plea agreement recommended two years probation, but the judge rejected that deal, sentencing him to 10 years.
Moore disputed the charges, saying moments after the sentencing, “This is bull****. This is not right. This is not right. I did not steal $47,000.”
The Iowa Supreme Court ruled this week that the Dubuque County district judge who sentenced Moore relied on an unproven allegation that he misappropriated $47,000. Moore does admit to misappropriating $15,000.
The state conceded the error, and has said it would vacate Moore's sentence, allowing a different judge to levy a new sentence.
A former board member says the funds Moore misappropriated were from registration fees or from door-to-door fundraisers. Court documents say the stolen money was deposited in Moore’s FanDuel account, and used to pay for hotel reservations, groceries, gas and online purchases.
There is no date set yet for Moore’s resentencing.
