Ed Gilliland and Marybeth Lebo will have their criminal cases dismissed as long as they are not charged with any other crimes over the next 12 months.
They must also comply with other requirements to avoid prosecution under the agreement signed Dec. 20 by a judge in Allen County, where the case was moved because of pretrial publicity.
Among the stipulations is they help create a pilot program designed to educate and train administrators and employees of LaPorte High School on how to properly report under Indiana law suspected abuse or neglect.
Gilliland is still the high school athletic director while Lebo remains a teacher but no longer is the girls varsity volleyball coach.
Gilliland and Lebo were charged with Class B misdemeanor failure to report for not going to the proper authorities despite having knowledge about a sexual relationship between a female player and her junior varsity coach, Robert Ashcraft, from 2007 to 2009.
Ashcraft, 48, is currently serving a 21-year prison sentence.
Both Gilliland and Lebo must meet with special prosecutor Sonia Leerkamp or some other designated individuals four hours each month to help create and implement the pilot program at the school.
Leerkamp said she drafted the agreement with a solution in mind as opposed to strictly punishment.
