Residency Dispute Leaves HS Student-Athlete Ineligible Despite Family Custody Changes

Henrico (Va.) County Public School District found Varina High School senior Darren Williams ineligible to compete in the remainder of the football season due to a discrepancy in the student’s residency. Williams and his family, in disbelief, have spent weeks trying to resolve the issue so that Williams will not lose out on lucrative college recruiting opportunities.

According to ABC 8 News, Williams spent his first three years at Henrico High School, but decided to transfer schools after witnessing a stabbing in December 2024 that left one student with life-threatening injuries. Williams’ grandmother, a resident of Varina, offered to take physical custody of Williams, which should have allowed him to transfer to the high school in her town and continue competing in athletics.

The arrangement through the Henrico County Juvenile Court also allowed Williams’ parents to retain partial custody but live separately.

However, after starting for two football games at Varina, the Henrico County Public School District sent the Williams family a letter saying it “had investigated and found discrepancies with Williams’ residency,” and therefore ruled Williams ineligible to compete.

To rectify the issue, the family presented the school district with Williams’ grandmother’s identification and several proofs of address, but the school district denied their appeal.

“They did not do a home visit prior to them determining that he was ineligible. They did not interview either Ms. Turner, Mr. Williams or Ms. Cain — nor did they ever go to the home,” said Charlotte Hodges, Williams’ attorney.

Hodges has submitted an injunction, requesting that the school district allow Williams to continue to play for the remainder of the season, as there are only four games remaining. The court has not yet released a ruling on this matter. 

“[Williams] has dedicated himself to athletics from a young age,” the filing reads, in part. “The opportunity to attend college and pursue his student athletic career represents the culmination of years of hard work and determination. Without injunctive relief, all of [his] efforts and achievements would be jeopardized and the potential to advance his athletic career through college would be lost.”

In a statement, Henrico County Public School District said, “HCPS has a thorough student-athlete eligibility review process as well as a residency verification process that includes interviews, documentation/guardianship review and home visits to ensure a student is staying at least 50% of their time at the registered home of record. There is also an exhaustive appeal process where materials and decisions are reviewed as part of a system of checks and balances.”
