Surveillance video from a high school gym class in Beaver, Pa., reportedly shows the moment a teenager was touched inappropriately by another student, the students' parents said.
Kevin and Salina Showvaker said the alleged groping incident happened in December, and since then their 14-year-old daughter has been seeing a therapist, her grades are falling and she feels pushed aside, WTAE-TV reported.
The Showvakers made a complaint to the Beaver Borough Police Department seeking sexual assault charges to be filed against the other student, who is a senior, but no charges were filed.
They also asked the Beaver Area School District to expel the boy who touched their daughter, but that didn't happen either, the news station reported.
"We did a comprehensive investigation, as well as a comprehensive Title IX investigation, as well as ongoing communication with law enforcement," Superintendent Mark Holtzman said.
Holtzman said while the Title IX investigation found nothing, the district did discipline the boy in line with school policy. The details on the discipline are not being released, Holtzman told WTAE-TV, due to the student's privacy rights.
Holtzman said the boy claimed that he thought the girl was someone else, and didn't intend to touch her.
The girl's parents said the video shows otherwise and they will continue to push for charges or file a civil lawsuit.
"It's already so horrible that this happened to her, and then she does what she is supposed to do, right? Goes to the teacher? And she's not had any validation, recognition, support," Salina Showvaker said.
